    ALBANIA: New York state assembly to suspend inquiry into’s referral to Gov. Andrew Cuomo as soon as he leaves, the top Democrat said Friday.
    Cuomo announced his resignation on Tuesday amid allegations of sexual harassment, days after he came under increasing pressure to step down or face oustation from the Democrat-controlled legislature through the referral process. Cuomo then said he would not be in office for 14 days, when he would be replaced by Deputy Chief of Staff Katie Hotsul.
    The attorney general last week published an independent investigation that found that Cuomo had sexually harassed at least 11 women.
    President Carl Heastie said in a statement that the Assembly’s Judiciary Committee had heard from its lawyers that it could not prosecute and remove an elected official who is no longer in office. Nevertheless, Heastie said, the evidence gathered by the commission “could probably have led to prosecution articles if he had not resigned”.
    Since March, outside lawyers have been helping the commission conduct a wide-ranging inquiry into whether there were grounds for ousting Cuomo, a Democrat. The announcement came a day after the Convention originally set a deadline for Cuomo’s legal team to respond with any additional evidence that contradicts the allegations against him.
    Cuomo’s office and lawyer, Rita Glavin, did not respond to repeated requests for comment from the Associated Press on whether the governor was going to meet the deadline.
    “Let me be clear – the commission’s work in recent months, although incomplete, has revealed credible evidence of allegations made against the governor,” Lavine said.
    This included elements related to sexual harassment, misuse of state resources in conjunction with the publication of the governor’s book on the pandemic and “inappropriate and misleading disclosure of nursing home data”.
    As the answer to the legal question of ousting an outgoing official remained unclear for several days, some Democrats, including MP Ron Kim, had urged the Assembly to accuse Cuomo anyway of preventing him from running again in New York.
    Heastie said he had asked the chairman of the jury, Charles Lavine, to hand over “all the evidence gathered by the jury to the competent investigating authorities”.
    Cuomo is facing ongoing investigations by the attorney general into the $ 5 million book deal and state attorneys, who are scrutinizing the handling of nursing home death data. State ethics commissioners, who could impose fines on Cuomo, are also looking into similar issues.
    Hesti also cited “active investigations” by Manhattan, Albany, Westchester, Nassau and Oswego county prosecutors into alleged sexual harassment by Cuomo.
    Several women said the governor touched them inappropriately, including a current aide who said he grabbed her breast at his official residence, the Executive Mansion, last November. This assistant, Brittany Commisso, filed a criminal complaint that could lead to a misdemeanor charge.
    Some members of the jury, including Democrats Phil Steck and Kenneth Braunstein, said Friday morning that they wanted the committee to release at least one report of their findings to the public.
    Heastie’s statement did not say whether the committee would make its findings public.
    Heastie’s speaker Mike Whyland did not respond to repeated requests for comment Friday. Heastie on Monday estimated that the investigation had cost taxpayers “millions” so far, but did not respond to repeated requests from the AP for an assessment.
